# Printheim Terms of Use and Sale Last updated: July 1, 2026 Version: 1.0 These Terms of Use and Sale govern access to and use of Printheim, a digital marketplace for downloadable 3D models and related digital files. By accessing, registering, uploading, selling, buying, downloading or otherwise using Printheim, you agree to these Terms. --- ## 1. Definitions For the purposes of these Terms: **Printheim**, **Platform**, **we**, **us** or **our** means the Printheim marketplace and related services. **User** means any person using Printheim, including visitors, members, buyers, sellers, creators and designers. **Creator**, **Designer** or **Seller** means any User who uploads, publishes, offers, sells or distributes Digital Files on Printheim. **Buyer**, **Customer** or **Maker** means any User who purchases, downloads or accesses a Digital File on Printheim, whether free or paid. **Digital File**, **Design**, **Creation**, **Model** or **Content** means any downloadable digital material uploaded to Printheim, including STL, OBJ, 3MF, ZIP, images, renders, previews, textures, descriptions, instructions and related files. **Adult Content** means lawful content intended only for adults, including lawful erotic digital content. **Prohibited Content** means illegal, harmful, abusive, dangerous, non-consensual, exploitative or otherwise forbidden content under these Terms. **Report** means a notice submitted to Printheim concerning illegal content, intellectual property infringement, unsafe content, prohibited content, fraud, abuse or any other violation. **Payment Processor** means any third-party payment provider used by Printheim, including Stripe, PayPal, Payoneer, Hyperwallet or any other payment, payout, fraud-prevention, KYC or AML provider. --- ## 2. Nature of Printheim Printheim is a multi-seller online marketplace and hosting service for User-uploaded digital files. Printheim enables Creators to publish, sell and distribute Digital Files. Buyers may purchase, download and use those Digital Files according to the license selected or stated by the Creator. Printheim acts as a neutral technical, organizational and payment intermediary between Creators and Buyers. Printheim does not create, own, approve, pre-screen, legally verify or sell User-uploaded Digital Files as its own products. Creators act in their own name and on their own responsibility. Printheim does not perform full prior legal review of every uploaded file. In particular, Printheim does not pre-verify every file for copyright ownership, trademark rights, commercial licenses, third-party permissions, printability, safety, technical quality or legal status. Printheim may manage technical and financial aspects of transactions, including payment processing, commissions, payouts, refunds, disputes, chargebacks, reports, moderation and account enforcement. To the fullest extent permitted by law, Printheim is not responsible for User-uploaded Digital Files, their legality, intellectual property status, technical quality, printability, safety or use. --- ## 3. Account Registration and Eligibility To use certain features of Printheim, Users may be required to create an account. Users must provide accurate, current and complete information. Users may not use a false identity, impersonate another person, use another person’s information without permission, or create an account to evade a suspension or ban. Users must be at least 16 years old to use basic Platform features, unless a higher age is required by applicable law. Users must be at least 18 years old, or the age of majority in their jurisdiction, to buy, sell, receive payouts, access Adult Content, publish Adult Content or enter into payment-related transactions. By using Printheim, the User represents that they have the legal capacity to enter into these Terms. Printheim may refuse registration, suspend an account, require verification or restrict access where required by law, payment processors, sanctions rules, KYC, AML, DAC7, fraud prevention, platform safety or risk-management procedures. --- ## 4. Equal Treatment of Accounts Printheim owners, operators, administrators, moderators or affiliated persons may hold regular User or Seller accounts on the Platform. Such accounts are subject to the same publishing rules, reporting procedures, moderation, takedown rules, payment rules and liability as all other User accounts. Printheim does not grant hidden technical privileges or secret exemptions from these Terms to such accounts. Printheim does not manually favor specific accounts in a hidden or undisclosed way. Visibility of Content may depend on objective, technical or statistical factors, including relevance, category, tags, quality of listing, popularity, sales, ratings, recency, availability, compliance, search performance or other Platform mechanisms. If Printheim offers paid promotions, sponsored placements or advertising, such placements should be marked as promoted, sponsored or advertising where required. --- ## 5. Seller Registration and Verification A User who wants to publish or sell Digital Files may be required to create a Seller account. A Seller may be required to provide identity, business, tax, address, payment, VAT, company, KYC, AML or other verification information. The Seller represents that all information provided to Printheim is true, complete and up to date. The Seller is solely responsible for their own tax, accounting, registration, invoicing, consumer, customs, VAT, social security and regulatory obligations. Printheim is not responsible for false, incomplete or incorrect declarations made by Sellers concerning their legal status, tax status, VAT status, country of residence, business status or professional status. If a Seller regularly sells Digital Files for profit, the Seller is responsible for determining whether they must register a business, keep accounts, pay taxes, charge VAT, issue invoices or comply with other legal obligations. Printheim may disclose required information to competent authorities, payment processors or authorized entities where required by law, tax rules, AML, KYC, DAC7, court order, legal process, fraud prevention or protection of Printheim’s rights. --- ## 6. Publishing Content A Seller may publish only Content that: 1. they created; 2. they own; 3. they are authorized to publish and sell; 4. they have a valid license to use commercially; or 5. they may otherwise lawfully publish and sell. By uploading Content, the Seller represents and warrants that they have all rights, licenses, permissions and legal authority required to publish, sell and distribute that Content on Printheim. The Seller is solely responsible for: 1. authorship; 2. ownership; 3. legality; 4. licenses; 5. product description; 6. images, renders and previews; 7. file quality; 8. technical usability; 9. printability; 10. safety warnings; 11. intellectual property rights; 12. third-party permissions; 13. compliance with applicable law. Printheim does not require proof of copyright ownership or licensing before every upload. Printheim may request proof, documentation or explanation from the Seller if Printheim receives a Report, detects risk, receives a legal notice, receives a payment dispute, or considers verification necessary. Failure by Printheim to remove Content before receiving a Report does not mean that Printheim approves the Content, confirms its legality, confirms the Seller’s ownership, confirms a license or has actual knowledge of infringement. Printheim is not required to know every existing game, film, brand, character, logo, franchise, product, artwork, trademark, copyright, patent, industrial design, license or protected universe. Content inspired by third-party works, brands, games, films, characters, universes, products or intellectual property may be published only at the Seller’s own responsibility. The Seller represents that they have a lawful basis to publish and sell such Content. Printheim does not legalize, approve or confirm the legality of fan art or any Content referring to third-party intellectual property. --- ## 7. Technical License Granted to Printheim The Seller retains ownership of the rights they hold in their Content. By uploading Content, the Seller grants Printheim a non-exclusive, worldwide, royalty-free technical license to host, store, display, cache, back up, process, reproduce, format, transmit and make the Content available only as necessary to operate the Platform. This technical license includes the right to: 1. host the files; 2. store backups; 3. generate thumbnails and previews; 4. display product pages; 5. show images, renders and descriptions; 6. enable Buyers to download purchased or free files; 7. operate search and category functions; 8. process reports, disputes, refunds and chargebacks; 9. verify file integrity; 10. scan files for malware or safety risks; 11. maintain transaction records; 12. comply with legal obligations. This license does not transfer copyright ownership to Printheim. Printheim does not become the owner of the Seller’s Digital Files. Printheim may not sell the Seller’s source files outside the Platform without separate permission. Printheim does not use Sellers’ source Digital Files to train AI models without separate express consent from the rights holder. Public elements of a listing, such as thumbnails, titles, descriptions, previews and renders, may be used by Printheim to operate, display, index, promote and organize the Platform. --- ## 8. Model Quality, Printability and Safety The Seller is responsible for the quality, accuracy, completeness and declared printability of their Digital Files. The Seller should provide accurate technical information, including where relevant: 1. file format; 2. scale; 3. dimensions; 4. number of parts; 5. whether the model is cut or uncut; 6. whether the model is print-ready; 7. recommended printer size; 8. assembly requirements; 9. material recommendations; 10. safety warnings; 11. known limitations. Printheim does not guarantee that any Digital File: 1. is technically correct; 2. is manifold; 3. is printable on every 3D printer; 4. is compatible with every slicer; 5. is compatible with every material; 6. is safe after printing; 7. meets the Buyer’s expectations; 8. is suitable for any specific use. Printing, assembling, sanding, painting, wearing, modifying or using printed objects is done at the Buyer’s own risk. Printheim is not responsible for failed prints, wasted material, printer damage, physical injury, property damage or other consequences resulting from Digital Files uploaded by Users. The Seller should provide reasonable support to Buyers where the issue concerns missing files, corrupted archives, incorrect uploads, major description mismatch or clear technical defects. --- ## 9. Adult Content Lawful Adult Content is allowed on Printheim only for adult Users. Adult Content must be clearly marked as adult or 18+ at the time of publication. Printheim may hide Adult Content from logged-out Users, restrict it by age, exclude it from certain sections, limit its visibility, require additional warnings or apply safety filters. Adult Content is prohibited if it: 1. depicts minors; 2. depicts characters presented as minors; 3. suggests the involvement of minors; 4. is non-consensual; 5. depicts sexual harassment; 6. depicts sexual blackmail or sextortion; 7. depicts stalking or sexual abuse; 8. sexualizes violence, coercion, suffering or humiliation; 9. uses the likeness of a real person without consent; 10. creates or distributes sexual deepfake content without consent; 11. violates privacy, dignity, personal rights or applicable law. Printheim may immediately remove Adult Content that is not properly marked or violates these Terms. Printheim may suspend or terminate accounts that attempt to hide, mislabel, disguise or bypass Adult Content restrictions. --- ## 10. Prohibited Content and Safety Users may not upload, publish, sell, transmit, promote or distribute illegal, harmful, abusive, exploitative, dangerous or prohibited Content. Strictly prohibited Content includes: 1. sexual content involving minors or characters presented as minors; 2. non-consensual sexual content; 3. sexual harassment, sextortion, stalking, abuse or exploitation; 4. sexualized violence, coercion, suffering or humiliation; 5. sexual deepfakes or realistic sexual content depicting persons without consent; 6. content encouraging violence, hatred, self-harm or crime; 7. instructions for committing crimes or evading law enforcement; 8. malware, spyware, viruses, backdoors or harmful code; 9. firearm models, firearm parts, suppressors, regulated weapon components or files whose possession, manufacture, distribution or use may be illegal; 10. content violating privacy, dignity, safety or personal rights; 11. fake currency, official documents, seals, IDs, badges, security markings or government-style objects intended to deceive; 12. fraud, scams, money laundering, payment abuse or circumvention schemes. Printheim may use automated and manual technical measures to detect, limit, hide or remove Prohibited Content. Such measures do not create a general obligation to monitor all Content and do not mean that Printheim legally verifies every uploaded file before publication. Printheim may immediately remove Content, restrict visibility, block sales, suspend payouts, suspend accounts or permanently ban Users where there is suspected violation of law, these Terms, platform safety or third-party rights. Where Content may constitute a serious criminal offense or threat to personal safety, Printheim may preserve technical data, retain evidence and report the matter to competent authorities where required or permitted by law. --- ## 11. Intellectual Property The Seller represents and warrants that their Content does not infringe copyrights, trademarks, patents, designs, image rights, privacy rights, personal rights or any other third-party rights. If Content depicts or uses a brand, logo, product, character, game, film, series, universe, architecture, artwork, person, protected object or other legally protected element, the Seller is responsible for obtaining all necessary rights, permissions or licenses. Printheim does not actively pre-screen every Digital File for intellectual property status. Intellectual property concerns are handled through reporting, DMCA, notice-and-action procedures and other legally required mechanisms. A rights holder or authorized representative may report intellectual property infringement through the reporting tools available on Printheim or by using the official contact details published on the Platform. A valid intellectual property Report should include: 1. the exact URL of the reported Content; 2. identification of the allegedly infringed work or right; 3. description of the infringement; 4. the reporting party’s identity and contact information; 5. confirmation that the report is submitted in good faith; 6. confirmation that the information is accurate; 7. confirmation that the reporting party is authorized to act. After receiving a sufficiently complete Report, Printheim may remove, hide or restrict the reported Content as a protective measure. Removal or restriction does not mean that Printheim has finally decided the legal dispute. Printheim is not a court and does not act as the final authority for copyright, trademark, licensing or ownership disputes. The Seller remains responsible for any legal dispute arising from Content they uploaded. --- ## 12. DMCA Policy For copyright notices concerning the United States, Printheim may apply the Digital Millennium Copyright Act procedure under 17 U.S.C. §512. Printheim maintains contact details for its designated DMCA agent on the Platform. DMCA notices must be submitted using the official DMCA contact details published by Printheim. Upon receiving a complete and valid DMCA notice, Printheim will act expeditiously to remove or disable access to the reported Content, generally within 24 hours. Printheim may forward the notice or relevant information to the affected Seller where required or permitted. The affected Seller may submit a counter-notice where available under the DMCA procedure. Printheim may restore Content where the legal requirements for restoration are satisfied. Independently of the DMCA process, Printheim may keep Content removed, restrict an account, suspend a Seller or terminate cooperation where the Content or Seller creates legal risk, repeated reports, payment risk, chargebacks, abuse, fraud, platform harm or violation of these Terms. Printheim maintains a repeat infringer policy. Accounts that repeatedly receive valid or substantiated infringement reports may be restricted, suspended or permanently terminated. --- ## 13. Notice and Action under the Digital Services Act Printheim provides a mechanism for reporting illegal Content in accordance with notice-and-action principles. Reports may be submitted through the reporting tools available on the product page or through the official contact details published by Printheim. A Report should include: 1. the exact URL of the reported Content; 2. a description of the reported Content; 3. the legal reason why the Content is considered illegal; 4. the reporting party’s identity and contact information; 5. a good-faith statement; 6. confirmation that the information is accurate. Printheim may confirm receipt of the Report where the reporting party provided contact information. Printheim reviews Reports without undue delay, generally within an indicative timeframe of 24 to 48 hours. Printheim may remove, hide, restrict or leave Content available depending on the Report, available information, legal risk, platform rules and applicable law. Printheim may maintain an internal register of Reports where required by law. If Content is removed or restricted, Printheim may inform the affected Seller of the reason, legal basis and available remedies, unless prevented by law, safety, abuse-prevention requirements or protection of the reporting party. --- ## 14. Appeals Where required by law or made available by Printheim, a User may appeal a moderation decision. An appeal should be submitted within 30 days from the notice of the decision. The appeal should include: 1. account identification; 2. URL of the affected Content; 3. description of the decision; 4. explanation of why the User believes the decision is wrong; 5. supporting documents or evidence. Printheim will review appeals within a reasonable timeframe. Printheim may uphold, modify or reverse the decision. Printheim may refuse to restore Content or an account where there is legal, financial, reputational, safety, payment, chargeback, third-party rights or Terms-related risk. Printheim’s decision is final within the ordinary Platform process unless mandatory law requires otherwise. --- ## 15. Enforcement and Sanctions Printheim may apply enforcement measures proportionate to the nature, seriousness and repetition of the violation. Measures may include: 1. warning; 2. Content hiding; 3. Content removal; 4. sales blocking; 5. visibility limitation; 6. payout suspension; 7. refunding Buyers; 8. account feature limitation; 9. temporary account suspension; 10. permanent account termination; 11. ban on re-registration; 12. reporting to payment processors; 13. reporting to competent authorities. For a first less serious violation, Printheim may issue a warning and remove the affected Content. For repeated or more serious violations, Printheim may suspend or terminate the account. For serious violations, Printheim may immediately remove Content and permanently ban the account without prior warning. Serious violations include: 1. Prohibited Content; 2. sexual content involving minors; 3. malware; 4. firearm or regulated weapon files; 5. fraud; 6. payment abuse; 7. money laundering; 8. theft of another creator’s model; 9. mass infringement; 10. ban evasion; 11. threats, harassment or abuse toward Users or the Printheim team. --- ## 16. Payments, Commission and Payouts Payments on Printheim are processed by third-party Payment Processors. Printheim does not store full payment card details. Sellers set the price of their Digital Files unless Printheim applies minimum or maximum price rules. Printheim may charge a commission on sales. Printheim’s commission may cover hosting, technical operation, payment support, marketplace infrastructure, reporting systems, fraud prevention, moderation and other Platform services. Seller payouts are processed according to the payout schedule, limits and requirements made available on Printheim. Printheim may suspend, delay, reduce or refuse payouts where: 1. Content violates these Terms; 2. the account is under review; 3. a Report has been received; 4. a legal dispute exists; 5. a chargeback exists; 6. fraud is suspected; 7. a Payment Processor reports abuse; 8. KYC or AML verification is incomplete; 9. the Seller provided incorrect information; 10. refunds or claims are likely; 11. required by law or payment rules. Funds withheld due to violation may be used for: 1. Buyer refunds; 2. chargebacks; 3. payment processor fees; 4. dispute costs; 5. legal or administrative costs; 6. losses caused by the violation; 7. other obligations connected with the violation. Printheim is not responsible for payment delays, blocked payouts, rejected payments, currency conversion, chargebacks, fraud decisions, processor restrictions or banking issues caused by third-party Payment Processors, banks or financial institutions. Users may not complete off-platform transactions in order to evade Printheim’s commission, payment system, safety procedures or these Terms. --- ## 17. Refunds, Complaints and Withdrawal Rights Digital Files are delivered digitally. No physical product is shipped unless expressly stated otherwise. The Buyer receives access to download the Digital File after payment confirmation. For digital content, the statutory right of withdrawal may be lost once delivery begins if the Buyer has expressly consented to immediate delivery and acknowledged the loss of the right of withdrawal. Printheim may require a checkbox or similar consent before the purchase of Digital Files. Refunds may be granted where: 1. the file was not delivered; 2. the archive is corrupted; 3. the uploaded file is clearly wrong; 4. the product materially differs from the description; 5. the Seller failed to provide the promised file; 6. mandatory law requires a refund. The fact that a Buyer cannot print a model, lacks the correct printer, changes their mind, expected a different result, or failed to read the description does not automatically create a right to a refund. For technical issues, the Buyer should contact the Seller or Printheim support. Printheim may grant a refund at its discretion where required to protect Buyers, comply with payment rules, resolve disputes, prevent abuse or comply with applicable law. --- ## 18. Buyer License Purchasing or downloading a Digital File does not transfer copyright ownership to the Buyer. The Buyer receives only the license selected or stated by the Seller on the product page. Unless the product page clearly states otherwise, Digital Files are licensed for private, personal and non-commercial use only. Without an express commercial license, the Buyer may not: 1. resell the Digital File; 2. share the Digital File with third parties; 3. upload the Digital File to other websites; 4. sell copies of the Digital File; 5. sell modified versions of the Digital File; 6. sell physical prints made from the Digital File; 7. use the Digital File commercially. The Seller may offer a separate commercial license where supported by Printheim. The Buyer is responsible for complying with the license attached to each Digital File. --- ## 19. No Scraping, Copying or AI Use Users may not scrape, mass download, copy, index, archive, reproduce or extract Content from Printheim without permission from Printheim or the relevant rights holder. Users may not use Digital Files, renders, previews, descriptions, images, thumbnails or other Content from Printheim to train, fine-tune, test or feed AI systems without permission from the relevant rights holder. Users may not bypass technical protections, download limits, account restrictions, anti-fraud systems or Content protection systems. Violation of this section may result in account termination, loss of access, legal claims and reporting to competent authorities or service providers. --- ## 20. Technical Access to Files Printheim may have technical access to User files only to the extent necessary for: 1. hosting; 2. infrastructure maintenance; 3. backup; 4. security; 5. payment and transaction support; 6. report handling; 7. malware scanning; 8. data integrity verification; 9. checking whether an archive contains declared files; 10. technical analysis of file availability, opening or download issues. Technical access does not mean: 1. transfer of copyright; 2. commercial license acquisition; 3. ownership of the files; 4. legal approval of authorship; 5. legal approval of licensing; 6. actual knowledge of infringement. Printheim is not required to actively inspect every uploaded file for intellectual property status. --- ## 21. Privacy, Data and Logs The processing of personal data is governed by Printheim’s Privacy Policy. Printheim may process User data for: 1. account operation; 2. transactions; 3. payments; 4. payouts; 5. reports; 6. safety; 7. fraud prevention; 8. legal compliance; 9. tax compliance; 10. accounting; 11. KYC; 12. AML; 13. DAC7 where applicable. Printheim may store technical logs, transaction history, report history, account data and safety records for the period required by law or reasonably necessary to protect rights, prevent fraud and enforce these Terms. After account deletion, Printheim may retain data as necessary to: 1. comply with legal obligations; 2. defend legal claims; 3. respond to authorities; 4. prevent fraud; 5. enforce bans; 6. process tax, payment and accounting obligations. --- ## 22. Platform Availability Printheim is provided on an “as is” and “as available” basis. Printheim does not guarantee uninterrupted, error-free or permanent availability. Printheim may be temporarily unavailable due to updates, maintenance, technical failures, cyberattacks, hosting issues, third-party outages, payment provider issues, force majeure or other causes beyond reasonable control. Printheim is not responsible for data loss, service interruptions, download errors, display errors, delays, external service failures or lost profits to the fullest extent permitted by law. Sellers should keep their own backup copies of all Digital Files. Printheim is not a guaranteed private archive or permanent storage service. --- ## 23. Disclaimer and Limitation of Liability To the fullest extent permitted by law, Printheim is not responsible for: 1. User-uploaded Content; 2. infringement committed by Users; 3. quality of Digital Files; 4. printability of models; 5. safety of printed objects; 6. use or misuse of Digital Files; 7. Buyer-Seller relationships; 8. payment processor errors; 9. chargebacks; 10. fraud; 11. rejected payments; 12. indirect, incidental, special, punitive or consequential damages; 13. lost profits; 14. loss of data; 15. reputational harm. Where liability cannot be fully excluded, Printheim’s liability is limited to the amount actually paid by the relevant User to Printheim in connection with the transaction giving rise to the claim, unless mandatory law provides otherwise. Nothing in these Terms excludes liability that cannot be excluded under applicable mandatory law. --- ## 24. Indemnification The User agrees to defend, indemnify and hold harmless Printheim, its owner, operators, administrators, moderators, employees, contractors, service providers and affiliates from and against all claims, liabilities, damages, losses, proceedings, costs and expenses, including reasonable legal fees, arising out of or related to: 1. Content uploaded by the User; 2. sale or distribution of Digital Files by the User; 3. infringement of copyrights, trademarks, licenses, privacy, image rights, personal rights or third-party rights; 4. violation of these Terms; 5. violation of law; 6. fraud, payment abuse or chargebacks; 7. false information; 8. illegal or harmful use of Printheim. Printheim may withhold, set off or secure User funds to cover claims, refunds, disputes, fees, chargebacks, losses or costs resulting from a violation. --- ## 25. Account Termination A User may delete their account through the Platform settings or by contacting Printheim support. Account deletion does not release the User from liability for prior violations, transactions, reports, taxes, chargebacks, disputes or claims. Printheim may suspend, restrict or terminate an account where: 1. the User violates these Terms; 2. the User violates law; 3. the User publishes Prohibited Content; 4. the User infringes third-party rights; 5. the User receives repeated Reports; 6. the User commits fraud or payment abuse; 7. the User attempts to evade a ban; 8. required by Payment Processors; 9. required by law; 10. required for Platform safety. Printheim may refuse re-registration by a banned User. After account deletion, the User may lose access to account data, products, messages, download history and other features, subject to mandatory law. --- ## 26. Changes to Terms Printheim may update these Terms from time to time. Changes may be made for legal, technical, operational, payment, safety, anti-abuse, business or functional reasons. Where required by law, Users will be notified of material changes in advance. Continued use of Printheim after the effective date of updated Terms constitutes acceptance of the updated Terms. If a User does not agree to the updated Terms, they must stop using Printheim and may delete their account. --- ## 27. Governing Law and Disputes These Terms are governed by the law of the country in which the operator of Printheim is established, unless mandatory consumer-protection law provides otherwise. Disputes shall be submitted to the competent courts of the operator’s place of establishment, unless mandatory law gives the User the right to bring claims before another court. The parties should first attempt to resolve disputes amicably by contacting Printheim through the official contact details published on the Platform. Consumers do not lose the protection of mandatory laws of their country of residence where such protection cannot be waived by contract. --- ## 28. Final Provisions If any provision of these Terms is found invalid, illegal or unenforceable, the remaining provisions remain in full force. Failure by Printheim to enforce any provision immediately does not constitute a waiver of the right to enforce it later. Users may not assign their rights or obligations under these Terms without Printheim’s consent. Printheim may assign or transfer its rights and obligations in connection with reorganization, sale, merger, acquisition, change of ownership or change of platform operator.
